Dallas County's ten justice courts all apply the same statewide rules to a Midland Funding, LLC debt claim, but they don't all run their offices the same way. One court requires petitions to be e-filed and takes answers by email; another accepts filings only in person, by mail or through e-filing; one court holds evening hours twice a month; one recently moved. If Midland has sued you in a Dallas County justice court, the page for your specific court is worth reading before you file anything.
This guide covers that local, court-by-court process. The Midland companies themselves, their bonds and the CFPB orders are explained in our guide to being sued by Midland Funding or Midland Credit Management in Texas. Court locations across the county are listed on our Dallas debt defense page.

Start With the Court Name on Your Citation
Dallas County justice courts are identified by precinct and place, usually written as JP 1-1 through JP 5-2. The county says justice of the peace districts and constable precincts are the same, and it publishes a GIS map for finding the district that covers an address. If the court on your papers is in a precinct that doesn't match where you live, raise it with a lawyer early; Texas venue rules and the FDCPA's venue provision (15 U.S.C. § 1692i) both limit where a consumer can be sued. See where can a creditor sue me in Texas?
To confirm the case is real and see its status, use the county's courts portal, which the justice courts link as the place to check case status. Search by your name or the cause number. A justice court can hear a debt claim of up to $20,000 (Gov't Code § 27.031); a larger Midland claim would be in a county court at law or district court, which our guide to PRA suits in Dallas County covers.
What the Petition Tells You About Midland
The plaintiff. If the caption names Midland Funding, LLC, that is the company Midland's website describes as the owner of charged-off accounts, while Midland Credit Management (MCM) services the account and sends the letters. MCM can also own accounts itself, according to the same site. Whichever name is in the caption is the company that must prove ownership.
The required details. Because a debt buyer's suit in justice court is a debt claim case, Rule 508.2 requires the petition to give the original creditor, the account name and a masked account number, the charge-off date if known, the date of assignment and the names of prior holders. Compare these with your own records. A wrong original creditor or an account number you don't recognize is worth flagging; see can I be sued for a debt I don't recognize?
The attorney. The signature block names the lawyer who filed the case, with a State Bar number and usually a firm name. That is who handles the case for Midland from here on. Our collection law firm guides describe many firms that file these suits in Texas.
Your Answer Deadline
In justice court, a written answer is due by the end of the 14th day after you were served (Texas Rule of Civil Procedure 502.5). If the case is in a county court at law or district court, the deadline is 10:00 a.m. on the Monday after 20 days from service (Rule 99(b)). Use the answer deadline calculator. Calls with MCM don't extend either deadline; see does calling the collector stop the deadline?
How Filing Works in Different Dallas County JP Courts
Each Dallas County justice court has its own debt claims page with its own forms. A few examples from those pages show why it pays to check yours:
- JP 4-1 (Grand Prairie): requires all debt claim, small claims and eviction petitions to be filed through e-file, and says a defendant's answer form may be e-filed or emailed to the court's civil address. Its page also states that all court proceedings are held in person, and it posts a Motion for Virtual Appearance to be submitted at least three business days before a hearing.
- JP 3-1 (North Dallas): says it accepts filings in person, by mail or through electronic filing only, and posts a Defendant's Original Answer form, a jury demand form and a Motion to Appear Virtually.
- JP 5-1: announced that it moved on October 7, 2026 to the East Dallas Government Center at 9731 Lake June Road, 2nd floor. Its page posts a debt claim answer form and a self-representation packet for defendants, and states that appeals must be filed in person.
Filing through eFileTexas.gov works for every court, and whichever method you use, send a copy of your answer to Midland's attorney and keep proof that you filed it. Court rules and addresses change, so read your court's page close to the date you file.
Night Court at JP 4-2
The county lists night court for JP 4-2 at the Grand Prairie Government Center from 4:30 p.m. to 7:00 p.m. on the first and third Tuesdays of each month. The county page doesn't say which matters are handled during those hours, so call the court at the number on its page before relying on an evening visit. For most people with a lawyer, the question doesn't come up, since filings are made electronically.
Hearings: In Person, Virtual, or Not at All
Under Rule 500.10, a justice court may allow or require participants to appear by video, and when it does, the notice must include instructions for joining and for submitting evidence. In Dallas County, JP 4-1 states that its proceedings are held in person, and JP 3-1 and JP 4-1 both post forms for asking to appear virtually. If you need to appear remotely because of work or travel, file the request early. Our update on the remote-appearance rules lists the factors judges weigh.
If you answer, Midland must prove its case: that the account was yours, that it was breached, the correct balance after all credits, and that Midland owns the debt and how it got it (Rule 508.3). If you don't answer, the court can enter a default judgment on Midland's written evidence. The Dallas courts also post motions to set aside a default; for what is required, see can a default judgment be set aside in Texas?
Limitations
Texas generally allows four years to sue on a debt (Civil Practice and Remedies Code § 16.004). A debt buyer such as Midland Funding cannot sue on consumer debt after that period, and a payment doesn't revive the claim (Finance Code § 392.307). Compare the charge-off and last-payment dates in the petition with the filing date, and plead limitations in your answer if it applies.
Free Resources in Dallas County
The JP 4-1 page lists Legal Aid of NorthWest Texas and the Dallas Volunteer Attorney Program among its legal resources. The Dallas County Law Library is open to the public, and Legal Aid of NorthWest Texas serves eligible Dallas County residents. Court clerks can explain procedures but can't give legal advice.
If the Collection Crosses a Line
The FDCPA and the Texas Debt Collection Act prohibit misrepresenting a debt, threatening action that can't legally be taken and suing on time-barred consumer debt. Once you have a lawyer, a covered collector generally must deal with the lawyer, not you (15 U.S.C. § 1692c(a)(2)). Claims for violations are brought as a separate federal lawsuit, not as a counterclaim in the justice court case, and they are a separate legal service from debt defense. See our Texas FDCPA attorneys page.
