Sued by a Debt Collector or Debt Buyer in Texas

Debt buyers purchase old accounts from banks and sue in their own name. Find the company named as plaintiff for what it has to prove, the Texas rules that limit it, and how to respond.

A debt buyer has to prove more than the original bank would: that it owns your account, through each sale from the lender to the company suing you, and the amount it claims. Texas also bars debt buyers from suing on consumer debt after the four-year limitations period has run.
