Common questions
How many days do I have to answer a debt lawsuit in Texas?
In justice court (Justice of the Peace), your Answer is due by the end of the 14th day after the day you were served. In county or district court, it is due by 10:00 a.m. on the first Monday after 20 days have passed since you were served.
What if the last day falls on a weekend?
If the 14th day in justice court falls on a Saturday, Sunday or legal holiday, the deadline moves to the next business day. In county or district court, if that Monday is a holiday, the deadline moves to the next business day.
What happens if I don’t answer on time?
The plaintiff can ask for a default judgment: the court can give them what they asked for without hearing your side. With a judgment, the creditor can try to collect from bank accounts or property that isn’t protected.
How do I know which court my lawsuit is in?
Look at the top of the citation. It will say “Justice Court” or “Justice of the Peace” for justice court, or name a County Court at Law or District Court.
