Weslaco sits in the middle of the Rio Grande Valley along I-2, east of McAllen and west of the Cameron County line. Hidalgo County runs its eastern justice courts from here, so if you live in Weslaco and get sued over a credit card or loan, the case will often be heard in town. Texas Debt Law defends Mid-Valley residents in these lawsuits for a flat fee, in Spanish or English, with most of the work done by phone, text, email and e-filing.

The Mid-Valley's Justice Courts

Weslaco had about 43,864 residents in 2024, according to the U.S. Census Bureau, all in Hidalgo County. According to the county's Justices of the Peace page:

  • Precinct 1, Places 1 and 2 serve the "Weslaco / Mercedes / Eastern Hidalgo County Area." Both offices are at 1902 Joe Stephens Ave. in Weslaco (Suites 301 and 302).
  • Precinct 5 serves the Delta area, with its office in Elsa.

Justice court debt cases are generally filed in the precinct where the defendant lives. For a Weslaco address, that usually means Precinct 1. If you live north of town toward the Delta communities, your citation may name Precinct 5 instead.

Justice courts hear claims up to $20,000 (Gov't Code § 27.031). Larger claims are filed in a County Court at Law or a district court, both in Edinburg, the county seat.

Hidalgo or Cameron? Check the Caption

Weslaco is close enough to Cameron County that families, jobs and mailing addresses often cross the line. The county that matters is the one in the caption at the top of your petition. If it says Cameron County, the case is in the Cameron County courts, with different precincts and clerks, and our Harlingen page covers that county. If it says Hidalgo County, read on.

If you were sued in a county where you don't live, tell us. Where a case is filed can matter, and it's something we look at early.

A Justice Court Case, Step by Step

1. Service

A constable, sheriff's deputy or private process server hands you (or leaves for you) the citation and petition. Write down the date.

2. The answer

Due by the end of the 14th day after service (Tex. R. Civ. P. 502.5). If the 14th day falls on a weekend or legal holiday, it moves to the next business day. Our answer deadline calculator does the counting. In a County Court at Law or district court, the deadline is instead 10:00 a.m. on the Monday after 20 days (Rule 99(b)).

3. Requests for proof

We ask the plaintiff for the documents that support its claim: the contract, the statements and, for a debt buyer, the records showing it owns your account.

4. Negotiation or trial setting

Many cases are resolved before trial, either because the plaintiff can't back up its claim or because both sides reach an agreement. If the case goes to a hearing, we prepare you and tell you whether you need to be there.

5. Closing the file

Whatever the outcome, we confirm that the court's records reflect it.

Defenses We Raise

  • Limitations. The general deadline to sue on a debt in Texas is four years (Civ. Prac. & Rem. Code § 16.004). Debt buyers can't sue on time-barred consumer debt (Fin. Code § 392.307).
  • Standing. A debt buyer must show the account was transferred to it.
  • Inadequate evidence. Generic affidavits and summaries are not the same as account records.
  • Wrong amount. We challenge interest and fees that aren't supported.

In a County Court at Law or district court, a summary judgment motion must be answered 21 days after it's filed (Rule 166a, for motions filed on or after March 1, 2026).

En Español, Sin Problema

Many of our Mid-Valley clients prefer to talk about their case in Spanish, and so do the relatives helping them. That's how we'll handle it. Court filings are in English, but we explain every one. This page is also available in Spanish.

After a Judgment, and When Collectors Misbehave

If a judgment has been entered, we can review it and negotiate a post-judgment settlement for the same flat fees as debt defense. Texas protects current wages from garnishment for consumer debt, your homestead, and personal property up to $50,000 (single) or $100,000 (family), but non-exempt bank funds can be taken.

Threats, lies and harassment by collectors can violate federal and Texas law. See our FDCPA and Texas Debt Collection Act page; those claims are a separate service.
