Texas Debt Law

Being sued and served

What is a petition in a debt case?

Short answer

The petition is the plaintiff's written claim. It says who is suing, what account the debt comes from, how much they want, and why they say you owe it. Your Answer responds to the petition.

In a justice court debt claim case, Rule 508 requires the petition to include details such as the original creditor, the last digits of the account number, and the amount owed, so missing details can be a defense.
