Texas law allows some claims to be raised as counterclaims, but that isn't how we handle collector violations. If a collector broke the FDCPA or the Texas Debt Collection Act, we bring a separate lawsuit in federal court. You still need to answer the collection case on time; defending it is a separate matter.
An FDCPA claim generally must be filed within one year of the violation, so tell us about collector misconduct early. Claims against a collector are a separate legal service, not included in the debt-defense flat fee.
