Kyle sits on I-35 between Austin and San Marcos, and with about 65,833 residents (U.S. Census Bureau, 2024 estimate) it is one of the larger cities in Hays County. Even though many people here work or shop in Austin, Kyle is entirely in Hays County. A debt lawsuit against a Kyle resident is a Hays County case, heard either in a justice court in Kyle or at the county courts in San Marcos.

Texas Debt Law defends Kyle residents sued by credit card issuers, debt buyers, collection agencies and lenders. We charge flat fees and handle most of each case by phone, text, email and e-filing, so you rarely need to take time off work.

Precinct 2: The Justice Courts in Kyle

Hays County has seven justice courts in five precincts. According to the county's Justice of the Peace page, Precinct 2 has two of them, Place 1 and Place 2, both in Kyle. The other precincts sit in San Marcos (Precinct 1, two places), Wimberley (Precinct 3), Dripping Springs (Precinct 4) and Buda (Precinct 5).

Justice courts hear civil claims up to $20,000 (Gov't Code § 27.031). That covers most credit card and personal loan suits. Precinct boundaries are drawn by the county, not by city limits, so don't assume a Kyle address means a Kyle courtroom. The court name on your citation is what counts.

When Your Case Is in San Marcos Instead

If the plaintiff asks for more than a justice court can award, or simply chooses a higher court, the case goes to one of Hays County's three County Courts at Law or to a district court. The county's District Court page lists the 22nd, 207th, 274th, 428th, 453rd and 483rd District Courts, administered from the Hays County Government Center in San Marcos. Those cases are more formal, with written discovery and motions, and the timeline is different.

Three Things to Do This Week

  1. Find the date you were served. In justice court, your answer is due by the end of the 14th day after service (Tex. R. Civ. P. 502.5). In a County Court at Law or district court, it's due by 10:00 a.m. on the Monday after 20 days (Rule 99(b)). Our answer deadline calculator does the counting.
  2. Don't call the plaintiff's lawyer to "explain." A phone call isn't an answer, and anything you say about the debt can be used to prove it.
  3. Gather what you have. Old statements, payment receipts, letters from collectors and the date you last paid all help us test the plaintiff's version.

How a Defense Takes Shape

We start by filing your answer so no default judgment can be taken. Then we ask the plaintiff to back up its claim.

When the plaintiff is a debt buyer, the chain of title matters. It has to show that your specific account passed from the original lender to the company suing you. Bulk sales often come with thin records. We also check whether the account defaulted more than four years before suit (Civ. Prac. & Rem. Code § 16.004), because a debt buyer can't sue on time-barred consumer debt (Fin. Code § 392.307).

If the case is in county or district court and the plaintiff moves for summary judgment, the response is due 21 days after the motion is filed (Rule 166a, for motions filed on or after March 1, 2026). We calendar it and respond with evidence and objections.

Some clients prefer to settle once they see the weaknesses in the file. When that's your choice, we negotiate the terms and confirm in writing how the case will be dismissed.

If a Collector Crossed the Line

Threats, false statements about what you owe, or repeated calls after you asked them to stop may break the federal Fair Debt Collection Practices Act or the Texas Debt Collection Act. These claims are a separate legal service from defending the lawsuit. Learn more on our FDCPA and TDCA page.

Kyle FAQs

I live in Kyle but work in Austin. Can I be sued in Travis County?

Consumer debt suits are generally filed where you live, and Kyle is in Hays County. If you were sued in another county, tell us. Venue may be worth challenging.

My papers were left with my roommate. Was I served?

Maybe, maybe not. Texas rules on who may be served and how are specific. Send us the citation and the officer's return, and we'll check whether service was valid before your deadline is calculated.

The case is in Precinct 2. Will I have to appear in person?

Your answer can be filed without appearing. If the court sets a trial, we'll tell you what to expect and whether you need to be there.

What if they win? Can they take my paycheck?

No. Texas doesn't allow garnishment of current wages for consumer debt (Tex. Const. art. XVI, § 28). Homestead and most personal property are protected too (Prop. Code chs. 41 and 42). Money in the bank is the main risk. If a judgment already exists, see our page on post-judgment debt settlement.
